In May of 2012, reports surfaced that Darius McClintock-Hunter, the son of then-Los Angeles Angels outfielder Torii Hunter, was one of five arrested and charged with the sexual assault of a Prosper High student, the high school McClintock attended at the time.
McClintock-Hunter was a top athlete at the school, with hopes of playing Division I college football, potentially even joining his older brother Torii Hunter Jr. at Notre Dame. A Prosper High girl accused McClintock-Hunter and three other male students of forcing her and another girl to have sex, but renounced her own story two days later and admitted he was not involved. Still, the Prosper police forged on with an investigation after a grand jury failed to indict him.
Due to the serious charges facing him, McClintock-Hunter was suspended from his football team and lost scholarship offers from several major Division I programs such as Arkansas, Oregon, and Louisiana State.
According to reports, the lawsuit states that McClintock-Hunter wants to "recover damages against the girls and the parents of the girls who made the false accusations of sexual assault against Darius that falsely branded as a 'criminal,' ruined his reputation, sent him to an alternative school for a year, got him kicked off the Prosper High School football team and banned from high school sports." McClintock-Hunter is seeking $40 million worth of damages from the two girls' families and Prosper Police Department who, according to McClintock-Hunter's lawyer Larry Friedman, "investigated a crime that didn't exist for over a year after the accuser recanted her complaint."
Friedman released a statement saying, "No one has taken responsibility for what they've done to this young man. No one's said sorry. In today's world, these types of things go viral in a minute. There are millions of stories out there accusing him of sexual assault that can never be erased. You can never erase those allegations. He will live to be 100 years old, barring something unforeseen. For the next 80 years those allegations will be there. The impact of this is tremendous."
