Former Patriots tight end Aaron Hernandez, who was convicted of the first-degree murder of his former friend Odin Lloyd this summer, was denied a new trial by Judge Susan E. Garsh, based on alleged misconduct by a juror.

An anonymous person posted the following regarding the Hernandez trial.

“Even though we weren’t supposed to talk about things with others, I find it humorous now that nobody knows we did talk amongst ourselves and you still believe we didn’t. I hope you pick us again so we can do it again to another thug.”

The defense is alleging that this misconduct could be enough for a mistrial, but Garsh has denied a request to find the name of the anonymous poster. Hernandez’s lawyers want to identify this person, since they claim to have impacted the verdict.

Hernandez Lawyers Want A New Trial

In Garsh’s rejection, she wrote that this poster did not necessarily imply any rules were broken.

“Apart from the fact that the survey, which can be completed by anybody regardless of whether he or she actually served on a jury, was completed by someone using a Utah-based Internet service provider,’’ Garsh wrote, “the defendant [has] not shown that an allegation that jurors talked among themselves during the trial merits inquiry.”

Garsh may not be buying this as grounds for a new trial, but Hernandez’s legal team also has a mystery woman who claims to have information about this juror. Garsh is considering a closed-door meeting with this person, according to The Boston Globe.

While all this goes on, Hernandez is still facing double-murder charges in the 2012 drive-by shooting of Daniel de Abreu and Safiro Furtado in Boston after an altercation in a nightclub.
