In the woman's favor are two apparent new pieces of information not present in previous hearings or investigations. The first is a Facebook status from Winston's then-teammate Ronald Darby the day after the alleged incident, in which Darby seemed to acknowledge with contrition a violent rape occurred and he did not intervene to stop it.

The second new piece of information is that a cab driver took Winston and the alleged victim to an off-campus apartment that evening.
