An accident in which the driver of a car heading in the opposite direction swerved into the lane of a car driven by the brother of Oscar Pistorius has resulted in a serious driving charge.

Reuters is reporting that 29-year-old Carl Pistorius has been charged with reckless and negligent driving during a head-on collision in August, 2014. Colonel Ronel Otto told Reuters that a Limpopo Province court in South Africa brought the charge against Pistorius because he did not give a statement following the accident, despite repeated police appeals.

"Mr. Pistorius did not want to submit his statement; he was charged mainly because of that," she said.

Back in August, International Eyewitness News reported that Carl Pistorius was driving back from a business meeting in the city of Polokwane in South Africa when a car heading in the opposite direction swerved into Pistorius' lane and collided with him.

ITV.com reported that Pistorius suffered lacerations to his heart and went into respitory failure after the crash. A witness to the collision told ITV News that the car that Pistorius collided with had strayed into the path of his vehicle, and claims that a police vehicle was involved in the smash.

Eyewitness News added that authorities announced both drivers required the Jaws of Life to be removed from their cars.

"Carl suffered poly-trauma injuries during the accident," family spokeswoman Anneliese Burgess told AFP at the time.

"These included lacerations to his heart and liver and he also went into respiratory failure. He has made a miraculous recovery after specialist care intervention and was discharged from ICU late last week. Carl is overwhelmed with gratitude for the support he has received from family, friends and the public."

The incident adds to the court woes of the Pistorius family. Oscar Pistorius, who was serving a five-year sentence on a culpable homicide charge in the shooting death of girlfriend Reeva Steenkamp, now will be headed back to court after prosecutors won the right to appeal the verdict.

Pistorius, who went to prison in October, was schedule to be released into house arrest after 10 months, but legal experts say that won't happen with the retrial approaching.

The prosecution now will try to persuade an appeals panel of five judges to convict Pistorius of murder, which could carry a 15-year sentence.
