Of course, nothing that happens to V. Stiviano is cut and dried.

One of two V. Stiviano alleged assailants behind bars

The New York Daily News is reporting that the lawyer of alleged attacker Dominick Diorio says that Stiviano made up the incident that she was attacked for attention.

"I'm confident that as this case goes forward and the investigation continues, that Ms. Stiviano's allegations will likewise begin to fail and at the end of the day the assault charge will be demised as well," attorney David Scott Smith said after the arraignment.

"Simply put, a credible victim of a crime does not have her attorneys call the press before she calls the police. Ms. Stiviano seems intent on keeping her name in the spotlight."

Diorio was arrested for allegedly punching Stiviano outside a New York City hotel on Sunday night. The Daily News reported that Diorio was released after his arraignment on reduced charges Wednesday.

Initially, police charged Diorio with assault as a hate crime, but the complaint that prosecutors filed included only a top charge of third-degree assault, which is a misdemeanor.

The maximum penalty is a year in prison. Diorio was released without bail.

The Daily News added that Diorio allegedly told investigators that Stiviano threw a phone at him, "and I ducked and hit my head."

That's when he allegedly used a racial slur against her.

Yeah, I'll f---ing hit a girl. I'll hit you, you n----- bitch."

Stiviano has been in the spotlight since a recording she made of Los Angeles Clippers owner Donald Sterling that included racist remarks, was leaked to TMZ, which made the audio public.

Sterling, who called Stiviano his girlfriend, received a lifetime ban from the NBA and recently was forced to sell the team. Former Microsoft CEO Steve Ballmer bought the Clippers for $2 billion.

Stiviano also has been under scrutiny. She had denied having a romantic relationship with him, but in the audio, she refers to Sterling as "Honey." Several people believe that she leaked the audio herself, an allegation she denies.

Former Los Angeles Dodgers manager Tommy Lasorda said he hoped "she gets hit with a car," and a recent video that Stiviano made in 2011 in which she made insulting comments about black people also became public.
