A prosecutor in the Tony Stewart case announced Tuesday that a grand jury will determine whether he will be charged in the death of Kevin Ward Jr., according to reports.

According to ESPN, Ontario County (NY) District Attorney Michael Tantillo said reviewing the evidence collected by the county sheriff's investigators led him to decide to present the case to a grand jury.

"I look forward to this process being completed, and I will continue to provide my full cooperation," Stewart said in a statement.

On Aug. 9, Stewart's car struck and killed Ward, a fellow driver, during a sprint car race in upstate New York. Ward's car spun out while racing alongside Stewart. Ward then climbed out of his car and walked down the track, apparently trying to get Stewart's attention.

"Upon my review of all of the information contained in the entire investigation," Tantillo said, "I have made the determination that it would be appropriate to submit the evidence to the grand jury for their determination as to what action should be taken in this matter."

Stewart spent three weeks away from racing after the incident. He returned for the final two races of the Sprint Cup season, though he failed to qualify for the Chase to the Sprint Cup championship field. Stewart finished 18th in Sunday's first Chase race at Chicagoland Speedway.

Stewart-Haas Racing said Stewart will still compete in Sunday's Chase Race at New Hampshire Motor Speedway.

"We are aware of the completed investigation and the announced next steps," NASCAR spokesman Brett Jewkes said. "We will monitor this process and stay in close contact with Stewart-Haas Racing. It would be inappropriate for NASCAR to comment on this case so we will continue to respect the process and authorities involved."
