Miami police have yet to formally close a sexual assault investigation in which San Francisco 49ers star quarterback Colin Kaepernick was implicated.

The 26-year-old veteran quarterback told TMZ last week "the district attorney has the information today. At this point, I'm going to let them handle their business," fueling speculation that the investigation targeting him, teammate Quinton Patton and Seattle Seahawks receiver Riccardo Lockette was on the verge of wrapping up.

Miami police chief Manuel Orosa seemed to agree with Kaepernick when he later told reporters "our investigation has been presented to our Miami-Dade State Attorney's Office and we await their decision whether to prosecute or not."

But according to TMZ, the Miami-Dade Office of the State Attorney insists investigators are still "waiting for scientific evidence" before authorities determine if the probe will continue or not.

On the night of April 2, a woman told investigators she spent the evening with the NFLers drinking and smoking marijuana before awaking to find herself in an hospital emergency room where she was administered a rape kit and subjected to a battery of other tests.

Kaepernick has professed his innocence throughout the ordeal and earlier this month 49ers coach Jim Harbaugh boasted that he expects a breakout year from his star quarterback.

"I really expect a real breakout year for Colin," Harbaugh was quoted on the team's website as saying. "Athletically, he looks bionic. If you all remember the 'Six Million Dollar Man,' that's what he looks like to me."

Kaepernick threw for 3,197 yards and 21 touchdowns last season in leading the 49ers to a 12-4 regular season.
